Travel Waiver for Ko’ox Fiesta Travel LLC
I. Introduction
This Travel Waiver Agreement (the “Agreement”) is entered into between Ko’ox Fiesta Travel LLC, located at [AGENCY ADDRESS] (hereinafter referred to as the “Agency”), and [TRAVELER NAME] (hereinafter referred to as the “Traveler”), regarding the travel services provided by the Agency as outlined herein.
II. Scope of Agreement
Ko’ox Fiesta Travel LLC agrees to provide travel services to [TRAVELER NAME] for the following purpose:

The Traveler acknowledges that they have read, understood, and agree to comply with the terms and conditions outlined in this Agreement.
III. Assumption of Risks
The Traveler acknowledges and understands that travel inherently involves certain risks, including but not limited to:
The Traveler agrees that Ko’ox Fiesta Travel LLC shall not be held liable for any loss, damage, or injury incurred during travel, except in cases of gross negligence or willful misconduct on the part of the Agency.
IV. Release and Agreement Not to Sue
The Traveler, on their own behalf, and on behalf of their heirs, executors, administrators, legal representatives and assigns, hereby forever releases, discharges, and covenants not to sue Ko’ox Fiesta Travel LLC and their respective agents, officers, directors, employees, and other participants (collectively referred to as “Released Parties”) from all liability, claims, demands, losses, or damages caused or alleged to be caused directly or indirectly by the Released Parties’ conduct or failure to act in any way arising from or related to the Traveler’s participation in the trip activities.
V. Indemnification
The Traveler agrees to indemnify, defend, and hold harmless the Released Parties from and against all fines, penalties, claims, losses, costs, damages, suits, and expenses including, but not limited to, attorney’s fees, court costs, and expert fees resulting from, caused by, or in any way relating to or arising out of the Traveler’s participation in the trip activities.
VI. Property Damage
The Traveler agrees to be financially responsible for any damage caused to hotel rooms, transportation vehicles, or any other property during the trip. The Traveler will promptly reimburse Ko’ox Fiesta Travel LLC or the affected party for any such damages.
VII. Alcohol Consumption
The Traveler acknowledges that alcohol consumption laws and customs may differ in other countries. The Traveler agrees to consume alcohol responsibly and in compliance with local laws. Ko’ox Fiesta Travel LLC is not liable for any consequences resulting from the Traveler’s alcohol consumption.
VIII. Group Conduct and Punctuality
The Traveler understands that if they choose not to follow the group or arrive late to designated meeting points, they do so at their own risk and expense. Ko’ox Fiesta Travel LLC is not responsible for any additional costs incurred due to the Traveler’s separation from the group or tardiness.
IX. Travel Insurance
Ko’ox Fiesta Travel LLC strongly recommends purchasing comprehensive travel insurance. The Traveler acknowledges that if they choose not to purchase travel insurance, they are responsible for any financial losses or medical expenses incurred during the trip.

XI. Photo and Video Release
The Traveler hereby grants Ko’ox Fiesta Travel LLC the right to take photographs and videos of the Traveler during the trip and to use such images and videos for advertising, promotional, and commercial purposes. The Traveler agrees that Ko’ox Fiesta Travel LLC may use such photographs and videos with or without the Traveler’s name for any lawful purpose, including publicity, illustration, advertising, and web content.
XII. Jurisdiction
This agreement shall be governed by and construed in accordance with the laws of [INSERT APPLICABLE JURISDICTION].
